Terms of Service

1. Acceptance of Terms

By accessing or using the Rakora AI mobile application (the "App") and its services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App. These Terms apply to all users of the App, including visitors, registered users, and others who access or use the Service.

We may amend these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. You are advised to review these Terms periodically for any changes. Changes to these Terms are effective when they are posted on this page.

2. Description of Service

Rakora AI allows users to interact with various AI personas, customize their personalities and moods by adjusting parameters (e.g., Humor, Dominance, Current Energy, Romantic, Anger, Kindness, Intelligence), and listen to their unique voices. Users can send text messages and upload images to interact with the AI. The core purpose is to allow users to create a customizable and personalized AI friend or partner.

3. User Accounts

To access certain features of the App, you must register for an account. You may register using your Google account. You are responsible for safeguarding your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading.

4. User Conduct and Responsibilities

You agree not to use the App to:

  • Violate any applicable laws or regulations.
  • Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Engage in any activity that facilitates or promotes Child Sexual Abuse and Exploitation (CSAE). Please refer to our Child Safety Standards for more details.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
  • Transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
  • Interfere with or disrupt the App or servers or networks connected to the App.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, removing the offending content from the App, suspending or terminating the account of such violators, and reporting you to law enforcement authorities.

5. User-Generated Content

You are solely responsible for the text messages you send and the images you upload ("User Content") when interacting with the AI personas. You retain all ownership rights in your User Content. However, by submitting User Content to the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and our business, including for promoting and redistributing part or all of the Service.

You represent and warrant that you have all necessary rights to grant the licenses granted in this section and that your User Content, and your provision thereof through and in connection with the App, complies with all applicable laws, rules, and regulations.

6. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Rakora AI and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Rakora AI.

7. In-App Purchases and Credits

The App may offer in-app purchases for credits, which can be used to interact with AI personas. New users receive an initial 25 free credits. Additional credits can be earned through our referral program or purchased through the App. All purchases are processed through the respective app stores (e.g., Google Play Store, Apple App Store). We do not store your payment card details. Pricing for credits is subject to change. All purchases are final and non-refundable except as required by applicable law or app store policies. Please refer to our Refund Policy for details on eligibility for refunds.

8. Referral Program

Rakora AI offers a referral program where users can earn extra credits by referring new users to the App. Both the referrer and the referred user will receive bonus credits as specified in the App. We reserve the right to modify or terminate the referral program at any time, with or without notice. Abuse of the referral program may result in the revocation of referral credits and/or account suspension.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may request account deletion by following the instructions on our Account Deletion page.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOUR USE OF THE APP IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAKORA AI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; NOR DO WE MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE APP, OR AS TO THE ACCURACY, RELIABILITY, OR CURRENCY OF ANY INFORMATION OBTAINED THROUGH THE APP. THE AI RESPONSES ARE GENERATED AND DO NOT REPRESENT REAL OPINIONS OR FACTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RAKORA AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

12. Indemnification

You agree to defend, indemnify, and hold harmless Rakora AI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Rakora AI is based, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and disclose your information.
